The report examines present law and practice in light of international human rights standards and the insights of developmental psychology. It recommends changes at all stages of dealing with children accused or convicted of homicide.

The recommendations include:

  • A review of the age of criminal responsibility
  • Changes to the procedures for trying children under 14
  • A single offence of homicide for children
  • Sentencing discretion to be with the trial judge
  • Release decisions to be made by a judicial body
  • Independent annual review of young people in indeterminate detention
